1. About these terms

These Terms and Conditions govern your use of https://www.carpartsmarket.co.nz and any order you place with Car Parts Market (CPM) (we, us, or our). They apply together with our Privacy Policy, Returns and Refunds Policy, Shipping and Delivery Policy, Warranty Policy, and any product-specific terms disclosed before purchase.

By using the website or placing an order, you agree to these terms. If you place an order for another person or business, you confirm that you have authority to bind them.

Nothing in these terms excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded, including applicable rights under the Consumer Guarantees Act 1993 (CGA) and Fair Trading Act 1986 (FTA). If these terms conflict with a mandatory legal right, the legal right prevails.

2. Eligibility and accounts

You must be at least 18 years old, or have the involvement and consent of a parent or legal guardian, to create an account or place an order.

You agree to:

  • provide complete, current, and accurate contact, vehicle, billing, delivery, and payment information;
  • keep your login credentials confidential and use a strong, unique password;
  • promptly tell us if you suspect unauthorised use of your account;
  • ensure that anyone using your account with your permission complies with these terms; and
  • not impersonate another person or use information you are not authorised to provide.

We may require reasonable identity, address, vehicle, or payment verification before accepting or releasing an order. We will handle verification information under our Privacy Policy.

3. Acceptable use

You must not:

  • use the website for unlawful, fraudulent, abusive, or misleading activity;
  • interfere with the website's operation, security, or other users;
  • introduce malicious code, probe for vulnerabilities, or attempt unauthorised access;
  • use automated tools to scrape, copy, or overload the website except with our written permission or as permitted by law;
  • submit content that is unlawful, defamatory, infringing, or harmful;
  • manipulate prices, promotions, reviews, inventory, checkout, or payment processes; or
  • resell website access, misuse our trade marks, or represent that you are affiliated with us without permission.

We may suspend access, cancel an affected order before acceptance, or take other proportionate action where we reasonably believe this section has been breached. We will not use this right to avoid a valid consumer claim.

4. Product information and aftermarket parts

We take reasonable care to keep product descriptions, specifications, images, prices, stock information, and compatibility data accurate. Minor colour, finish, packaging, branding, or manufacturing-batch differences may occur if they do not make the product materially different from its description or unsuitable for its stated purpose.

Unless a listing expressly states that a product is genuine original equipment (OEM), products are aftermarket products made by or for third-party manufacturers. References to vehicle makes, models, trade marks, OEM numbers, or part numbers identify compatibility or intended use only. They do not imply sponsorship, manufacture, or endorsement by the vehicle manufacturer.

Product photographs may show optional accessories or multiple components. The written listing and the stated package contents determine what is included. Contact us before ordering if anything is unclear.

5. Vehicle fitment and compatibility

5.1. Your fitment checks

Vehicle parts can differ within the same make, model, and year because of build date, chassis or VIN range, engine, transmission, trim, market specification, factory option, prior modification, and mid-model production changes.

Before ordering and again before installation, you must:

  • check the full listing, dimensions, side and position, connector and pin configuration, OEM or cross-reference numbers, and all notes;
  • provide accurate make, model, year, build date, engine, transmission, body style, registration, VIN or chassis details when requested;
  • compare the supplied part with the original part before fitting, painting, cutting, programming, or altering it; and
  • ask us for assistance if compatibility is uncertain.

A registration, VIN, catalogue, search, or vehicle-filter result is a compatibility aid. It is not, by itself, a diagnosis of the vehicle fault.

5.2. Fitment Guarantee

Our Fitment Guarantee applies only when, before purchase:

  • the product page expressly displays “Fitment Guaranteed” for the customer's exact vehicle; or
  • our team confirms compatibility in writing after receiving all vehicle information we reasonably request.

The guarantee depends on the information being complete and accurate and the vehicle remaining in the specification disclosed to us. If the confirmed part does not fit, stop work and contact us before modifying or forcing the part. Subject to inspection, we will provide the correct part or a refund and will cover reasonable approved return freight.

The voluntary Fitment Guarantee does not cover a fitment issue caused by incomplete or inaccurate vehicle information, an undisclosed modification, installation error, or use outside the confirmed application. It covers the part and reasonable approved freight, not diagnostic, removal, installation, calibration, towing, storage, loss-of-use, or similar costs, except to the extent the law requires us to cover a reasonably foreseeable loss.

These conditions do not limit any CGA guarantee that applies because you made a particular purpose known to us and reasonably relied on our skill or judgment, or because the product does not match its description.

6. Installation, safety, and DIY work

Auto parts can affect steering, braking, suspension, lighting, restraint systems, cooling, fuel delivery, emissions, electrical systems, and other safety-critical functions. Product information on the website is general information and is not a vehicle diagnosis, workshop manual, or substitute for manufacturer procedures.

You are responsible for ensuring that installation, coding, calibration, testing, certification, and post-installation checks are performed by a person with the necessary competence, tools, information, and legal authorisation. A qualified automotive technician or auto electrician should install any safety-critical, electrical, electronic, programmed, pressurised, or technically complex product. Any product-specific instruction requiring professional installation must be followed.

Before installation, the installer should identify and correct the root cause of the original failure, check related systems and components, use the correct fluids and consumables, follow applicable torque and safety specifications, and complete any required programming or calibration.

To the extent permitted by law, we are not responsible for loss caused by:

  • incorrect DIY or third-party diagnosis, selection, installation, wiring, coding, calibration, adjustment, or maintenance;
  • failure to follow product, vehicle-manufacturer, or safety instructions;
  • continued use after a warning sign, malfunction, or unsafe condition appears; or
  • another defective, contaminated, incompatible, or improperly installed component.

This limitation applies only to the extent that the relevant act or omission caused or contributed to the loss. It does not exclude liability for a defective or misdescribed product or any other liability that cannot lawfully be excluded.

7. Prices, GST, and payment

Prices are in New Zealand dollars. For New Zealand supplies, product prices are displayed as “EX GST:” and “INC GST:” using the current New Zealand standard GST rate of 15%. Products exported from New Zealand may be zero-rated where the legal requirements are met. The total payable to us, including the GST treatment applied, delivery, and any lawful payment surcharge, is shown before you place the order. Destination-country import duties, taxes, and clearance charges are additional unless checkout expressly states that they are included.

Where you choose a Stripe payment method, including a card, wallet, or pay-later option, the payment surcharge is calculated as (base order total × 2.65%) + NZ$0.30, rounded to the nearest cent and capped at 4% of the base order total. The applicable surcharge amount and final total are shown before payment. POLi, where available, has no customer payment surcharge. We calculate and verify these amounts on the server.

You must pay the total displayed at checkout using an available payment method. Card, wallet, and pay-later payments are processed by Stripe, and bank-payment options may be processed by POLi, where those methods are displayed at checkout. These providers may apply their own terms and privacy statements. We do not collect or store raw card numbers, card security codes, bank passwords, internet-banking credentials, or bank-account credentials on our application servers.

A temporary authorisation, payment capture, or automated order acknowledgement does not by itself mean that we have accepted your order. If we do not accept an order after taking payment, we will promptly submit a full refund through the applicable payment method.

Promotional codes and discounts:

  • must be used according to their stated terms;
  • cannot be redeemed for cash or combined unless expressly allowed;
  • may be withdrawn or corrected before an order is accepted if published in genuine error; and
  • do not limit statutory rights for discounted or sale goods.

8. Orders and contract formation

Website listings are invitations for you to make an offer. When you place an order, you offer to buy the selected products on these terms. We may send an automated acknowledgement, but the sale contract is formed only when we send a dispatch or ready-for-collection confirmation, or otherwise expressly accept the order.

Before acceptance, we may decline or cancel an order for a legitimate reason, including:

  • stock unavailability;
  • an obvious price, description, or system error;
  • failed payment or a reasonable fraud or security concern;
  • a product, delivery-address, legal, safety, or carrier restriction; or
  • an order quantity that exceeds a disclosed limit or available supply.

We will contact you where reasonably practicable. If we cancel all or part of a paid order, we will submit the corresponding refund. We will not replace an ordered product with a materially different product without your agreement.

9. Availability, backorders, and cancellations

Stock may change between viewing a product and order acceptance. Any backorder, special-order, or preorder status and estimated availability will be disclosed where known.

You may request cancellation by contacting info@carpartsmarket.co.nz as soon as possible. Cancellation is not guaranteed after we have accepted, packed, specially ordered, customised, or dispatched the product. If cancellation is unavailable, the Returns and Refunds Policy applies. Any cancellation charge for a special-order or customised product will be limited to a reasonable amount reflecting loss we cannot reasonably avoid, and will be disclosed before the order is placed where applicable.

We may cancel an accepted order if supply becomes impossible, unlawful, or unsafe. We will give notice and a refund for any product we cannot supply. This does not limit any additional remedy available by law.

10. Delivery and collection

Our Shipping and Delivery Policy forms part of these terms. Delivery dates are estimates unless we expressly agree to a guaranteed date. When we arrange delivery to a consumer, we remain responsible for ensuring the product is delivered within the agreed time or otherwise within a reasonable time, and for resolving loss, misdelivery, or transit damage with our carrier.

International delivery is available only for a destination and product supported at checkout or confirmed by us before order acceptance. The customer or recipient must comply with reasonable import and customs requirements and may be responsible for destination duties, taxes, clearance charges, and product-use restrictions as detailed in the Shipping and Delivery Policy.

You must provide a complete, accurate, and serviceable delivery address and any access information requested. You may be responsible for reasonable additional carrier costs caused by an incorrect address, refused delivery, or failed delivery where the failure was within your control and the cost was disclosed or is otherwise lawfully recoverable.

For click and collect, wait for a ready-for-collection message before travelling. We may require the order reference, collection code, and reasonable proof of identity or authority. Collection by another person must follow our disclosed verification process. See our click and collect information.

11. Returns, refunds, and warranty

Our Returns and Refunds Policy and Warranty Policy form part of these terms.

We offer a voluntary 30-calendar-day return for eligible products where a customer changes their mind or makes an ordering error. Restrictions apply to used, installed, altered, special-order, clearance, hazardous, and sensitive electrical or electronic products. Those voluntary restrictions never apply to the extent a product is faulty, unsafe, misdescribed, incorrectly supplied, or otherwise covered by a mandatory legal right.

All aftermarket products supplied by us include our voluntary three-month warranty, beginning on delivery or collection. That warranty is additional to the CGA. Depending on what a reasonable consumer would expect, statutory rights may continue after the three-month warranty has ended.

12. Recalls and product safety

Do not use a product that appears unsafe, is subject to a safety notice, or may cause vehicle damage or personal injury. Stop using the vehicle where continued use may be unsafe and contact us promptly.

We may contact purchasers or other affected people with safety, recall, or corrective-action information. You agree to reasonably cooperate with a lawful recall, including stopping use and making the product available for inspection, repair, replacement, or refund. A recall does not limit any statutory remedy.

13. Website content and third-party services

We may update website content, correct errors, and change future product offerings without notice. Changes do not alter a contract already accepted unless you agree or the change is required by law.

The website may link to third-party sites, vehicle databases, payment services, maps, tracking pages, or other services. We do not control third-party content and are not responsible for it merely because we provide a link. Your use of a third-party service may be governed by that provider's terms. We remain responsible for our own obligations and cannot avoid a consumer obligation by referring you to a third party.

We do not guarantee uninterrupted or error-free website availability. We may reasonably suspend access for security, maintenance, or events beyond our control.

14. Intellectual property

Unless stated otherwise, the website and its original text, design, graphics, software, product photography, logos, and trade marks are owned by or licensed to Car Parts Market (CPM). You may view and make a reasonable copy of content for personal shopping and record-keeping purposes.

You may not reproduce, republish, modify, distribute, commercially exploit, or create derivative works from protected content without permission, except as allowed by law.

If you provide a review, photo, or other content, you retain ownership. You give us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, and display it for the purpose for which it was submitted. You confirm that you have the right to provide it. We will not materially change the meaning of a customer review and may moderate content for privacy, relevance, illegality, abuse, or infringement.

15. Liability

15.1. Non-excludable rights

Nothing in these terms excludes or limits:

  • rights or remedies under the CGA, FTA, or other law that cannot be excluded;
  • liability for fraud, wilful misconduct, or any other liability that cannot lawfully be limited; or
  • your right to recover reasonably foreseeable loss caused by a failure covered by the CGA.

15.2. Customer-caused loss

To the extent permitted by law, we are not liable for loss to the extent it is caused by your inaccurate information, misuse, unreasonable delay after discovering a fault, unauthorised repair, incorrect selection against our clear advice, or improper installation, modification, maintenance, storage, or use.

15.3. Business customers

If you acquire products in trade and for business purposes, then, to the extent permitted by law and only where it is fair and reasonable:

  • you and Car Parts Market (CPM) agree in writing that the CGA does not apply; and
  • our aggregate liability relating to the affected product is limited, at our option, to repair, replacement, resupply, or the price paid for that product.

To the extent permitted by law, neither party is liable to the other for indirect or consequential loss, loss of profit, loss of revenue, loss of production, loss of contract, or business interruption. This paragraph does not exclude liability that cannot lawfully be excluded and does not apply to a consumer acquisition covered by the CGA.

We do not purport to contract out of the FTA for standard online orders. Any separate negotiated agreement to contract out of specified FTA provisions must satisfy all statutory requirements, including that both parties are in trade, the agreement is in writing, and it is fair and reasonable.

16. Events beyond reasonable control

Neither party is responsible for delay or failure caused by an event beyond its reasonable control, such as a natural disaster, severe weather, epidemic, strike, transport disruption, cyber incident despite reasonable safeguards, government action, or utility failure.

The affected party must take reasonable steps to reduce the effect and resume performance. This section does not require you to accept indefinite delay and does not remove any right you have under the CGA or other law, including rights relating to delivery within an agreed or reasonable time.

17. Complaints and disputes

Please contact us first so we can try to resolve the issue:

We will acknowledge and assess complaints within a reasonable time. You may also seek independent advice from Citizens Advice Bureau or Community Law. Depending on the dispute, you may be able to apply to the Disputes Tribunal or another New Zealand court or tribunal.

18. Governing law

These terms and each order are governed by New Zealand law. The New Zealand courts and tribunals have non-exclusive jurisdiction, subject to any mandatory right to bring a claim elsewhere.

19. Changes to these terms

We may update these terms for future use of the website and future orders. We will publish the effective date and version. The version made available to you when we accept an order applies to that order unless a change is required by law or you agree otherwise.

20. General

If a provision is unlawful or unenforceable, it will be read down to the minimum extent necessary or severed, without affecting the remaining provisions.

Our failure to enforce a provision immediately is not a waiver. You may not transfer your contractual rights or obligations without our consent, except where the law permits. We may transfer our rights and obligations as part of a genuine sale or restructure of the business if this does not reduce your rights.
